The FMCSA Drug and Alcohol Clearinghouse records drug and alcohol program violations for commercial drivers. This page explains who is covered and what a driver may need to do there.

Who is covered

Any driver who holds a commercial driver's license (CDL) and is subject to the CDL standards in 49 CFR Part 383 and the FMCSA drug and alcohol testing program in 49 CFR Part 382. References to CDL drivers also include commercial learner's permit (CLP) holders.

What drivers may need to do

• Register. Drivers need to register with the Clearinghouse only to complete the actions below.
• Respond to consent requests. Give consent when a current or prospective employer requests a full query, including every pre-employment query. A driver who does not consent is prohibited from performing safety-sensitive functions, including operating a commercial motor vehicle, for that employer (49 CFR 382.703(c)).
• Review their record. Drivers can view their own Clearinghouse record.
• Designate a SAP. A driver with a violation designates a substance abuse professional (SAP) in the Clearinghouse.

How driver information is protected

• Only selected registered users can access the Clearinghouse, and only for designated purposes.
• Other enforcement agencies, such as state driver licensing agencies and state law enforcement, receive only a driver's eligibility status.
• Drivers can access their own information free of charge, but not the information of other drivers.
• The Clearinghouse meets relevant federal security standards, and FMCSA regularly verifies its security protections.
