The FMCSA Commercial Driver's License Drug and Alcohol Clearinghouse is an online database of drug and alcohol program violations by CDL and CLP holders. If your company employs CDL drivers, you have duties in the Clearinghouse under 49 CFR Part 382, Subpart G, even when a consortium/third-party administrator (C/TPA) handles parts of your program.
What employers must do
- Query drivers. Query all prospective employees, and all current employees at least annually, who meet the definition of a CDL driver.
- Report. Report certain drug and alcohol program violations, negative return-to-duty (RTD) alcohol and controlled substances test results, and successful completion of a driver's follow-up testing plan.
Set up your Clearinghouse account
- Register. Register your company at the FMCSA Clearinghouse.
- Verify company information. If you have a USDOT Number, the Clearinghouse pulls your contact and company information from other FMCSA systems. Register early so you can check that it is up to date.
- Designate your C/TPA. If you work with one or more C/TPAs, you must designate them in the Clearinghouse before they can act for you. This is required of all owner-operators (employers who employ themselves as CDL drivers).
- Invite assistants. Invite other employees who will use the Clearinghouse for your company so they can register as part of your organization.
- Buy a query plan. All employers of CDL drivers must purchase a query plan. The plan lets you, and your C/TPA, query driver records. Query plans can be purchased only from the FMCSA Clearinghouse, after you sign in to your Clearinghouse account. Fees are set by FMCSA.
How Med-Stop helps
Med-Stop is not a C/TPA in the Clearinghouse: you cannot designate Med-Stop there, and Med-Stop does not run queries or report violations, return-to-duty results, or follow-up results for your company. Your company queries and reports in its own Clearinghouse account, or through a C/TPA it designates there.
