DOT Rules and Regulations / Part 382: Controlled substances and alcohol use and testing / Subpart G—Requirements and Procedures for Implementation of the Commercial Driver's License Drug and Alcohol Clearinghouse / §382.713 Duration, cancellation, and revocation of access

(a) Term

Clearinghouse registration is valid for five (5) years, unless it is cancelled or revoked.

(b) Cancellation

The Federal Motor Carrier Safety Administration (FMCSA) will cancel a Clearinghouse registration for any user who has not conducted a query or submitted a report to the Clearinghouse within a two-year period.

(c) Revocation

FMCSA reserves the right to revoke a Clearinghouse registration for any user who fails to comply with the prescribed rights and restrictions governing access to the Clearinghouse.

This includes, but is not limited to:

  • Submitting inaccurate or false information
  • Misusing or misappropriating access rights or protected Clearinghouse information
  • Failing to maintain required qualifications, certifications, or training as outlined in 49 CFR Part 40
