FMCSA Clearinghouse / Med-Stop as the FMCSA Clearinghouse TPA
You can use Med-Stop as your company FMCSA Clearinghouse TPA - during the registration please search for MED-STOP, set it as your FMCSA Clearinghouse level TPA. Please remember - Med-Stop is the TPA only for the FMCSA Clearinghouse querying and reporting - Med-Stop is not the TPA for all other FMCSA, DOT-regulated tasks.
Employers have to register with the FMCSA Clearinghouse - go to the https://clearinghouse.fmcsa.dot.gov/Register. If you want Med-Stop to be your company FMCSA Clearinghouse level TPA - select MED-STOP as your TPA.
Please read carefully and sign the "Med-Stop Third-Party Administration of Federal Motor Carrier Safety Administration Drug and Alcohol Clearinghouse Agreement" - available in the Med-Stop FMCSA Clearinghouse reports - fax signed document back to Med-Stop fax number (877) 867-5768 or scan and upload the agreement. After Med-Stop receives the signed agreement we will confirm the FMCSA Clearinghouse TPA assignment for your company.
Your company has to purchase a Query Plan on the FMCSA Clearinghouse page - go to https://clearinghouse.fmcsa.dot.gov/Query/Plan for more information. Med-Stop as your company FMCSA Clearinghouse TPA will NOT be able to perform queries if your company has not purchased them.
Using Med-Stop, you will be able to request a full FMCSA Clearinghouse query for every applicant - CDL driver. This type of query requires the driver's electronic consent in the FMCSA Clearinghouse - you can send the text message notification for the driver from Med-Stop. The driver's notification and consent for the full queries are handled by the FMCSA Clearinghouse.
Transferring the driver in Med-Stop from applicant status to active employees will give you a reminder about the FMCSA Clearinghouse full query requirement as well as the possibility to print out and store in employee Documents the required limited query consent form. All CDL holders have to be verified once a year by the limited FMCSA Clearinghouse query. This will be performed by Med-Stop only when the employee has the limited query consent form on file (in employee Documents).
If Med-Stop as your company FMCSA Clearinghouse TPA is not able to perform the query - because of no queries purchased by your company or lack of the driver consent - you will get the Med-Stop system alert.
All required but not performed queries will show as the COMPLIANCE warnings for the specific CDL driver.
Med-Stop will report required information to the FMCSA Clearinghouse - as long as it is properly recorded in the Med-Stop system. You are responsible for keeping your applicant, employee information up to date and correct. If there are any pre-employment or return-to-duty tests that are performed outside of the Med-Stop system and should also be reported to the FMCSA Clearinghouse - you have to enter them into the Med-Stop.
As required by the FMCSA rules and regulations, you will be also able to record a "Violation Actual Knowledge" - this information is also submitted to the FMCSA Clearinghouse.
