What happens if a driver has a violation in the Clearinghouse?

A driver with an unresolved violation is in "prohibited" status and may not perform safety-sensitive functions, including driving a commercial motor vehicle, for any employer (49 CFR 382.701(d)).
- The employer must remove the driver from safety-sensitive functions.
- The driver must complete the return-to-duty process with a SAP and pass a return-to-duty test before driving again.
- Since November 18, 2024, State licensing agencies must check the Clearinghouse and remove the CDL or CLP privilege of a driver in prohibited status until the driver completes the return-to-duty process (49 CFR 382.725, 49 CFR 383.73).
