If your company employs CDL drivers, it must query the FMCSA Drug and Alcohol Clearinghouse for every new driver and at least once a year for every current driver, and report certain violations and results. Your company does this in its own account at the FMCSA Clearinghouse, or through a consortium/third-party administrator (C/TPA) it designates there. Med-Stop is not a C/TPA in the Clearinghouse: you cannot designate Med-Stop there, and Med-Stop does not run queries or report violations, return-to-duty results, or follow-up results for your company.
What your company does in the Clearinghouse
- Buy a query plan from FMCSA in the Clearinghouse.
- Run a pre-employment full query before a driver first performs safety-sensitive functions for you; the driver gives electronic consent in the Clearinghouse.
- Run a query at least once a year for every driver; a limited query with the driver's general consent usually meets this requirement.
- Report the violations and results your company is responsible for by the close of the third business day.
What you may see in Med-Stop
The employer app may still show Clearinghouse information from Med-Stop's former Clearinghouse service. Use it as a reference only; your Clearinghouse account is the record of your queries and reports.
- The Compliance Status section of the Welcome screen may list drivers with Clearinghouse compliance items.
- An employee's History > FMCSA Clearinghouse shows the Clearinghouse information recorded in Med-Stop for that driver.
The Employees menu may include FMCSA Clearinghouse Queries and FMCSA Clearinghouse Reports, and the Company menu may show a Med-Stop TPA status. These screens do not run queries or file reports for your company. Menus depend on your company services and permissions.
