Appendix F to Part 40 — Drug and Alcohol Testing Information That C/TPAs May Transmit to Employers

If you are a Consortium/Third-Party Administrator (C/TPA), you may, acting as an intermediary, transmit the information listed below to the Designated Employer Representative (DER) for an employer, only if the employer authorizes you to do so.

These are the only items you are permitted to transmit to the employer as an intermediary. The use of C/TPA intermediaries is prohibited in all other cases, including but not limited to:

  • Transmission of laboratory drug test results to MROs
  • Transmission of medical information from MROs to employers
  • Transmission of SAP reports to employers
  • Transmission of positive alcohol test results
  • Transmission of any medical information from MROs to employers

In all cases, you must ensure that when transmitting this information, you comply with all applicable requirements, including confidentiality and timing, that would apply if the originating party (e.g., the MRO or collector) transmitted the information directly to the employer.

Example: If you transmit MRO drug testing results to DERs, you must comply with the transmission requirements specified in § 40.167.
